How Kelly Brickwork collects, uses and looks after your personal information.

Last updated:

The short version: we only use your details to reply to you, quote for and carry out your work, and keep the records the law requires. We never sell your information, and this website does not use cookies or tracking.

Who we are

This privacy policy explains how Kelly Brickwork Limited (“Kelly Brickwork”, “we”, “us” or “our”) collects, uses and looks after your personal information when you visit this website, get in touch with us or have us carry out work for you.

Kelly Brickwork Limited is a company registered in England & Wales (company no. 17471929). Our registered office is 140 Park Street Lane, Park Street, St Albans, Hertfordshire, AL2 2AU.

We are the controller of the personal information described in this policy. This means we decide how and why it is used, and we are responsible for looking after it under UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

If you have any questions about this policy or how we handle your information, please contact us:

What information we collect

We only collect the information we need to deal with your enquiry and carry out your work. This may include:

  • Details you give us through our contact form: your name, phone number, email address, town or postcode, the service you are interested in, your timeframe, details about your project and how you would prefer us to contact you.
  • Details you give us in other ways: when you email us, phone us or message us on Instagram, including anything you choose to tell us about your property or project.
  • Information we need to quote for and carry out work: such as the address of the property, details about the site and access, and the information we need to invoice you and keep a record of payments.
  • Insurance repair details: if the work is part of an insurance claim, your claim reference and the contact details of your insurer or loss adjuster.
  • Basic technical data: like most websites, our hosting provider automatically records some technical information when you visit, such as your IP address, browser type and the pages requested, in its server logs. This is used to keep the website secure and working properly.

We may also receive your details from someone else, such as your insurer or loss adjuster, or a builder or developer we are working with, when they ask us to carry out work at your property.

You do not have to give us any information. However, we will need your name and a way to contact you so we can reply to your enquiry, and the property address so we can quote for and carry out work. We do not ask for sensitive information such as health details. If you choose to tell us something like this, for example a mobility need so we can plan the work around it, we will only use it for that purpose.

How we use it

We use your personal information to:

  • reply to your enquiry and answer your questions;
  • visit your property, talk through the options and prepare a quote;
  • arrange, carry out and complete the work we agree with you;
  • send invoices, take payment and keep our business and accounting records;
  • deal with your insurer or loss adjuster on an insurance repair, when you ask us to;
  • keep this website secure and working properly; and
  • handle any questions, complaints or claims about our work.

We do not send marketing messages, and we do not use your information for automated decision-making or profiling.

Our lawful bases

UK data protection law says we must have a lawful basis for each way we use your personal information. These are the bases we rely on:

How we use your personal information and the lawful basis for each purpose
Purpose Lawful basis
Replying to your enquiry and answering your questions Legitimate interests: responding to people who contact us about brickwork
Visiting your property and preparing a quote Contract: taking the steps you have asked for before entering into a contract
Arranging, carrying out and completing the work Contract: carrying out our agreement with you
Dealing with your insurer or loss adjuster on an insurance repair, at your request Contract, and legitimate interests: working with the parties involved in your claim
Invoicing, taking payment and keeping accounting and tax records Contract, and legal obligation: the tax and company law rules on keeping records
Keeping this website secure and working properly Legitimate interests: running a safe and reliable website
Handling complaints or legal claims Legitimate interests: dealing with complaints and establishing, exercising or defending legal claims

Where we rely on legitimate interests, we have weighed our interests against yours and only use your information in ways you would reasonably expect. You can object to this at any time (see your rights).

Who we share it with

We only share your information where we need to, and only the details needed for each purpose:

  • Web3Forms, the service that processes messages sent through our contact form and forwards them to our email inbox.
  • Our email and website hosting providers, which store and deliver our emails and run this website.
  • Our accountant, who helps us keep our books and prepare our accounts and tax returns.
  • Your insurer or loss adjuster, where you ask us to deal with them on an insurance repair.
  • HMRC or other authorities, but only where the law requires us to.

We never sell your personal information, and we never share it with anyone for their own marketing.

International transfers

Some of the service providers we use, such as Web3Forms and our email and hosting providers, may store or process information outside the UK. Where they do, we rely on appropriate safeguards to protect your information, such as UK adequacy regulations (where the UK has recognised that a country protects personal information to a suitable standard), or the International Data Transfer Agreement or International Data Transfer Addendum approved under UK data protection law.

Please contact us if you would like more information about these safeguards.

How long we keep it

We only keep your personal information for as long as we need it:

  • Enquiries that don't go ahead: up to 2 years from our last contact with you, in case you come back to us about the same project.
  • Customer and job records (such as quotes, invoices, payment records and correspondence about the work): 6 years after the end of the financial year in which the work was completed, for tax and legal purposes.
  • Website server logs: kept by our hosting provider for a limited period, in line with its own policies.

When we no longer need your information, we delete it.

Cookies and third-party content

We do not set any cookies on this website, and we do not use analytics, advertising or tracking tools. That is why you will not see a cookie banner here.

Some parts of our pages are loaded from other services. When this happens, your browser connects directly to that service, which receives your IP address and basic browser information so it can deliver the content to you:

Links to our Instagram profile take you to Instagram, which is run by Meta. Anything you do on Instagram, including sending us a message there, is covered by Instagram's own privacy policy (opens in a new tab).

Your rights

Under UK data protection law you have the right to:

  • Access: ask for a copy of the personal information we hold about you.
  • Rectification: ask us to correct information that is wrong or incomplete.
  • Erasure: ask us to delete your information.
  • Restriction: ask us to limit how we use your information.
  • Objection: object to us using your information where we rely on legitimate interests.
  • Portability: ask for information you have given us in a commonly used, machine-readable format, or for us to send it to someone else.

Some of these rights only apply in certain situations. For example, we may not be able to delete invoices that we have to keep for tax purposes, but we will always explain why.

To use any of your rights, email info@kellybrickwork.com or call 07578 325222. There is usually no charge. We may need to confirm your identity before we act on your request, and we will respond within one month.

Complaints

If you are unhappy with how we have handled your personal information, please contact us first so we can try to put things right.

You also have the right to complain to the Information Commissioner's Office (ICO), the UK regulator for data protection:
